Kiley, Kiley & Kiley obtains $375,000 settlement in medical malpractice case [2009-05-01]:

Donald T. Kiley, Jr. obtained a $375,000 settlement in a medical malpractice action for a Queens women who suffered a re-fracture of her elbow while undergoing physical therapy. Mr. Kiley obtained evidence that was crucial in settling the case, including the testimony of an expert Physiatrist who opined that the plaintiff’s residual loss of use of her arm was the proximate result of the second fracture. Mr. Kiley also proffered a study found in a prominent medical journal that suggested the plaintiff would have regained functional use of her arm had it not been re-fractured.
 
Kiley, Kiley & Kiley obtains $170,000 judgment for Queens woman who claimed property damage to her home as a result of neighbor’s construction project [2009-04-01]:

James D. Kiley obtained a judgement of $170,000 in the case of a Queens woman who sued the owner and contractor of an attached home that was undergoing renovation. The Building Department of the City of New York shut down the Richmond Hill construction site and issued numerous violations but not before significant property damage was done to the plaintiff’s adjoining home. After the building owner and construction company abandoned the project, Mr. Kiley successfully pursued a civil suit and obtained a judgement.

Kevin J. Kiley to be honored by St. Aidan's Church [2008-10-03]:

The Church of St. Aidan, Williston Park, New York will honor Kevin J. Kiley with the Jack Zwiebel Community Service Award for outstanding service to the community on Friday, October 3, 2008. Mr. Kiley and his wife Nancy raised their three children, Meghan, Kevin and Michael in Williston Park and have been members of St. Aidan's Parish for over 19 years. Mr. Kiley has been extremely active in the Parish of St. Aidan and in the Williston Park Community. Mr. Kiley is currently the President of the St. Aidan CYO, a member of the St. Aidan Church Finance Committee, the Council of Stewardship, Coordinator of the CYO Boys basketball program and a coach of several youth sports teams. In addition, Mr. Kiley is a former President of the St. Aidan Holy Name Society, the former chairman of the St. Aidan 5K run, and a former member of the St. Aidan Pastoral Council. In Williston Park, Mr. Kiley has served as the Village Prosecutor, as a member of the Recreation Committee, and as a coach in the Williston Park Little League and PAL. Mr. Kiley is also a member of the Board of Trustees of the CYO of Nassau/Suffolk, a member of the Holy Cross High School President's Council and has been Co-Chairman of the Holy Cross High School Alumni Golf Outing for the past 15 years.
 
Kiley, Kiley & Kiley wins Summary Judgement for Trump Management, Inc, dismissing Queens Action [2008-08-01]:

James D. Kiley successfully argued for Summary Judgment before the Hon. Marguerite Grays, Justice Supreme Court, dismissing the claims of a Queens woman against Trump Management, Inc. for alleged injuries sustained in an accident at a McDonald's restaurant originally leased by Trump Management, Inc. The Court agreed with the arguments of Mr. Kiley and found that the moving defendant had no duty of care to the plaintiff as a matter of law.
 
Kiley, Kiley & Kiley obtains a $550,000.00 medical malpractice settlement for woman who sustained loss of vision [2008-03-01]:

Donald T. Kiley, Jr. obtained a $550,000.00 settlement for a 78 year old woman who sustained loss of vision in one eye as a result of the failure of her opthamolgist to properly monitor her intra-ocular pressure due to a glaucoma condition. The case was successfully settled after a mediation with the doctor's insurance company.
 
Kiley, Kiley & Kiley obtains a $1,000,000.00 structured settlement for the wrongful death of a man crushed in a bailer [2007-11-01]:

Donald T. Kiley, Jr. obtained a $1,000,000.00 structured settlement for the wrongful death of a 30 year old man who was crushed in a cardboard bailer while at work. Video of the incident revealed that the man had put cardboard into the bailer and was crushed when the compressor came down on him. Despite the fact that the video footage appeared to show that the accident was caused by the victim's own negligence, Mr. Kiley conducted an investigation into the accident, met with OSHA officials and retained a consulting engineer who determined that the bailer had been damaged during installation and that its electrical wiring and safety switches had been bypassed. Mr. Kiley brought causes of action for product liability and negligence against the manufacturer and distributor of the bailer in Federal Court. After depositions were held, a structured settlement was reached which will pay the decedent's infant son over $1,000,000.00.
 
Donald T. Kiley, Jr. and Kevin J. Kiley give estate planning seminar on behalf of the Catholic Brooklyn/Queens Dioceses [2007-10-01]:

Donald T. Kiley, Jr. and Kevin J. Kiley gave a seminar on estate and elder law planning before a group people at Our Lady of the Blessed Sacrament Church, Bayside, New York. The event was sponsored by the Brooklyn/Queens Diocese. Topics of discussion included the fundamentals of preparing a basic estate plan including a Will and Health Care Proxy with discussion of the implication of the recent federal HIPAA legislation and its impact on medicaid planning. Also discussed were the most recent changes to the medicaid laws relating to gifts and the transfer of assets; a discussion of shelter credit and bypass trusts to mitigate federal and state estate tax liability and tools to address the preservation of real property and other assets, including life estates and irrevocable trusts.

James D. Kiley obtained a $150,000.00 settlement for a car accident victim who sustained a fractured vertebra in her spine. Mr. Kiley successfully argued the case in which the defendant claimed to have had the right of way.
 
Kiley, Kiley & Kiley obtains a $425,000.00 settlement for a truck driver who sustained nerve damage to his hand after a fall over a dangerous step [2006-12-01]:

Donald T. Kiley, Jr. obtained a $425,000.00 settlement for a bus driver who tripped over a step that violated the local building code. Mr. Kiley successfully defeated a motio n for summary judgement and subsequent appeal of the property owner who argued that the workers compensation law barred the recovery. Mr. Kiley was able to cite to evidence, including financial and insurance records, which distinguished the property owner from the plaintiff's employer as a matter of law and which proved that the plaintiff was entitled to a third party recovery.

James D. Kiley obtained a $175,000.00 settlement for a bus passenger who sustained a torn rotator cuff when the bus driver suddenly hit the brakes on a rural highway. Mr. Kiley successfully argued that the bus driver was negligent and that his conduct was distinguishable from the frequent unexpected stops associated with municipal busses on city streets, which the Courts have routinely cited in dismissing claims.
 
Kiley, Kiley & Kiley obtains $300,000.00 settlement for Brooklyn man [2006-07-01]:

In a case of first impression after recent Federal legislation eliminated the vicarious liability of leased and rental vehicle owners in New York State, Donald T. Kiley, Jr. obtained a $300,000.00 settlement for a Brooklyn man who sustained a degloving injury to his leg after being struck by a rental car in gas station. Mr. Kiley conducted an investigation which revealed that the rental car driver owned her own vehicle and prevailed in obtaining the full policy in settlement of the claim.
 
Kiley, Kiley & Kiley obtains $75,000.00 arbitration award for car accident victim [2006-06-01]:

The Hon. Joseph Giamboi rendered a $75,000.00 arbitration award for a Queens car accident victim who sustained a herniated disc to her neck. Donald T. Kiley, Jr. argued the case successfully after rejecting an offer from the insurance company of $17,500.00.
 
Kiley, Kiley & Kiley wins summary judgment dismissing Staten Island action [2006-04-01]:

A Richmond County Supreme Court Judge recently awarded Trump Management, Inc, Summary Judgement in an action brought by a tenant who claimed serious bodily injuries as a result of a fall on snow and ice in a parking lot. The Court agreed with the arguments of James D. Kiley, counsel for Trump Management, in finding that the defendant did not have notice of a dangerous condition since a storm was in progress.
 
Kevin J. Kiley appointed Prosecutor of the Village of Williston Park [2006-04-01]:

Kevin J. Kiley was recently appointed the Prosecutor for the Village of Williston Park. The Village Court sits every other Wednesday and hears disputes related to violations of the New York State Vehicle and Traffic Law, local ordinances and other matters.
 
Kiley, Kiley & Kiley obtains $210,000.00 settlement for elderly accident victim [2006-03-01]:

Kevin J. Kiley obtained a $210,000.00 settlement for an 87 year old woman who fractured her humerus in a fall on a city sidewalk. Mr. Kiley successfully argued that the adjoining landowner and contractor were liable for creating a dangerous condition on the property and that, since the condition was hidden from view, the plaintiff bore no culpability for the accident.

Donald T. Kiley, Jr. achieved a $150,000.00 settlement for an elderly woman in a malpractice claim against her Internist for neglecting to diagnose kidney failure. After jury selection and a trial conference the parties reached a mediated settlement. Mr. Kiley was further successful in negotiating a 2/3 reduction of the medicare lien.
 
Flatbush Federal Savings & Loan represented by Kiley, Kiley & Kiley in purchase of new Brooklyn branch [2005-12-01]:

Flatbush Federal Bancorp, Inc, the holding company of Flatbush Federal Savings and Loan Association ("the Association"), announced the purchase of the building of its Bensonhurst branch at 6410 18th Avenue, Brooklyn, NY, for $1.7 million. The purchase was made by the Association and the transaction was closed on November 21, 2005. The Association has serviced the Bensonhurst community since 1975 from the same location. The purchase replaces the current lease which expires on September 30, 2009. Kevin J. Kiley, of Kiley, Kiley & Kiley represented the Association in the purchase.
 
Kiley, Kiley & Kiley represents Trump Management in the sale of Brooklyn properties valued at over $10 Million [2005-12-01]:

Trump Management retained Kiley, Kiley & Kiley as counsel in the sale of several parcels of vacant land in the Coney Island and Gravesend sections of Brooklyn valued at approximately $10 million. James D. Kiley represented Trump at closing in what was the final chapter of the sale of its Brooklyn and Queens properties worth over $800 million.
 
Don Kiley, Sr. honored at the 50th Anniversary of Holy Cross High School [2005-11-01]:

The 50th Anniversary of Holy Cross High School, Flushing New York was celebrated on November 11, 2005 at Russo's on the Bay, Howard Beach. Many dignitaries were in attendance, including Queens Borough President, The Honorable Helen Marshall. The founder of Kiley, Kiley & Kiley, Donald T. Kiley, Sr. was honored with the Board Chair Emeritus Award for outstanding leadership and service to the school. Mr. Kiley was the first President of the Board of Directors of Holy Cross High School serving from 1979-1982.
 
Kiley, Kiley & Kiley makes the front page of the New York Law Journal in win on motion for summary judgement in Kings Supreme Court [2005-07-21]:

Just as land owners are not liable for injuries resulting from individual wet leaves, they are not liable for injuries caused by a pile of wet leaves either a Brooklyn Judge has held. Bibi Rakeeba Misir initiated a suit against the owners of Beach Haven Apartments No. 1. claiming that, on her way home from a doughnut shop, she slipped and fell on a three-to four foot pile of leaves stacked in the building's driveway sustaining serious injuries. Misir had testified that she had walked through the same pile of leaves without incident only 15 minutes earlier that day. In representing the defendant, James D. Kiley successfully argued that autumn leaves, in and of themselves, did not constitute a dangerous condition for which the owner may be held liable. In a case of first impression, the Court agreed with Mr. Kiley finding no liability for the defendant.
 
Kiley, Kiley & Kiley settles $400,000.00 malpractice claim against Mt. Sinai Hospital [2005-05-01]:

Donald T. Kiley, Jr. successfully obtained a $400,000 settlement with Mt. Sinai Hospital in a malpractice claim brought by the Estate of a Queens man who claimed injuries caused by the negligent administration of drugs in the hospital
 
Kiley, Kiley & Kiley wins appeal again in the Appellate Division Second Department [2005-02-01]:

James D. Kiley recently argued the case of Murphy v. Lawrence Towers Apartments, LLC 15 A.D.3d 371 before the Appellate Division Second Department. As counsel for the defendant, Mr. Kiley successfully argued that the order of the Supreme Court which denied defendant's motion for summary judgment should be reversed and the plaintiff's Complaint dismissed. In overturning the Supreme Court's decision, the Appellate Division agreed with Mr. Kiley's arguments that the defendant had no notice of a dangerous condition on its property.
 
Kiley, Kiley & Kiley wins another appeal in the Appellate Division Second Department [2004-06-01]:

James D. Kiley recently argued the case of Mallik v. Trump Management, Inc. 777 N.Y.S. 2d 732 before the Appellate Division Second Department. Representing the defendant, Trump Management, Inc. Mr. Kiley successfully argued the reversal of the decision of the Supreme Court which denied defendant's motion for summary judgement dismissing the Complaint. The Appellate Division concurred with the arguments of Mr. Kiley in finding that the defendant had no notice of a dangerous condition on its property.
 
Kiley, Kiley & Kiley wins appeal in the Appellate Division Second Department [2004-05-01]:

James D. Kiley recently argued the case of Rosario v. Trump Management, Inc. 7 A.D. 3d 504 before the Appellate Division Second Department. Representing the defendant, Trump Management, Inc, Mr. Kiley successfully argued that the Order of the Supreme Court, which granted summary judgment to the defendant, be upheld. The Appellate Division agreed affirming the lower Court's order in all respects.
 
Kiley, Kiley & Kiley obtains $650,000.00 settlement for a Bronx man who sustained a broken leg at the Hunts Point Market [2004-02-01]:

Donald T. Kiley, Jr. obtained a $675,000.00 settlement for a car accident victim who sustained a fracture tibia. Mr. Kiley successfully argued that the client, an employee of the Hunts Point Market, was forced into early retirement as a result of the accident and incurred economic loss, including lost benefits and a reduced pension.
